Nationally recognized immigration and criminal defense attorney, Sara Elizabeth Dill, of the national law firm of Perry, Krumsiek & Jack, LLP is an active speaker on the impact of the U.S. Supreme Court's ruling regarding the requirement that effective assistance of counsel requires criminal defense attorneys to advise defendants of the immigration consequences of a criminal conviction. The decision in Padilla v. Kentucky may have been one of the most important decisions since Gideon and Strickland, and significantly impacts the way defense counsel, prosecutors, and courts handle cases. Immigration lawyers also have a new possibility of seeking relief for their clients, through motions to vacate convictions based on a Padilla violation. Topics to be covered include: 1. Background of the intersection of immigration and criminal law; 2. What Padilla now requires counsel to do; 3. Practice pointers and helpful resources for practitioners; 4. The retroactivity of Padilla. This broadcast on ALR/PRA Radio airs 05/11/2010 at 3:00 pm Central (4ET/1PT) via http://www.blogtalkradio.com/alrpra and archive links will be available on the ALR/PRA web site.
